Terms of Service | RealtyFlow Systems

Agreement: By purchasing any RealtyFlow Systems service or using this website, you agree to these Terms of Service. Please read carefully before proceeding.

1. Services Provided

RealtyFlow Systems provides done-for-you automation and systems buildout for real estate professionals. Services include but are not limited to: lead response automation, database reactivation, appointment scheduling workflows, CRM configuration, compliance framework setup, and ongoing optimization. Specific deliverables are outlined in your tier selection at time of purchase.

2. Payment Terms

Setup Fees: Due in full at time of purchase via Stripe. Work begins upon payment confirmation.
Monthly Retainer: Billed monthly via Stripe subscription on your billing date. First payment due at time of purchase.
AI Voice Qualifier Add-On ($697): One-time fee billed separately if selected.
Failed Payments: Services may be paused if payment fails after two retry attempts. You will be notified by email.

3. Refund Policy

Setup Fees: Non-refundable once onboarding has begun (defined as your first onboarding call or database upload, whichever occurs first). If you cancel before onboarding begins, a full refund will be issued within 5 business days.

Monthly Retainers: Non-refundable for the current billing period. Cancel anytime with 30-day written notice to erics@realtyflow.xyz.

4. Cancellation

You may cancel your monthly retainer at any time by sending written notice to erics@realtyflow.xyz with subject line "Cancellation — [Your Name]". Cancellation takes effect at the end of the next 30-day billing period. You retain access to your configured system; ongoing optimization and support will cease at cancellation.

5. Deliverables & Timeline

System go-live target: 5–7 business days from onboarding call completion
Timeline may be extended if client-required information (database, Zillow access, approvals) is delayed
RealtyFlow Systems will communicate any timeline changes within one business day
60-day optimization sprint (Tier 2 and above) begins at system go-live date

6. Client Responsibilities

To ensure timely delivery, clients agree to:

Provide database export within 3 business days of onboarding call
Grant necessary platform access (Zillow, existing CRM) within 3 business days
Review and approve localized scripts within 48 hours of delivery
Ensure all contact data provided complies with applicable law and that proper consent exists
Notify us immediately of any compliance concerns regarding active sequences

7. SMS & Communication Compliance

Client acknowledges that SMS automation sequences built and managed by RealtyFlow Systems must be used in compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and Massachusetts state law. Client is responsible for:

Ensuring initial opt-in consent exists for all contacts in their database
Maintaining accurate suppression lists
Promptly honoring opt-out requests from their leads

RealtyFlow Systems builds TCPA-compliant frameworks including opt-out language and time-of-day guardrails. However, client bears ultimate responsibility for their own compliance obligations.

8. Intellectual Property

Automation frameworks, workflow logic, and system architecture developed by RealtyFlow Systems remain the intellectual property of RealtyFlow Systems. Localized scripts, messaging, and configurations built specifically for your account are licensed to you for use during your active subscription. Upon cancellation, license to proprietary frameworks terminates; your contact data and custom content remain yours.

9. Limitation of Liability

RealtyFlow Systems does not guarantee specific revenue outcomes, lead conversion rates, or commission results. Results depend on market conditions, client follow-through, and factors outside our control. Our liability for any claim arising from services is limited to the total fees paid in the 30 days preceding the claim.

10. Confidentiality

Both parties agree to keep confidential all proprietary information shared in the course of the engagement. RealtyFlow Systems will not disclose client business information, contact data, or system details to any third party without written consent, except as required by law.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved in the courts of Middlesex County, Massachusetts.

12. Changes to Terms

We reserve the right to update these Terms. Active clients will be notified by email of material changes at least 14 days before they take effect. Continued use of services constitutes acceptance.
